Shimla Deputy Commissioner Orders Strict Enforcement Of Supreme Court Missing Guidelines

Shimla :  The Shimla district administration has directed law enforcement agencies to ensure strict and immediate implementation of the Supreme Court’s landmark guidelines concerning missing persons, specifically targeting the protection of women and vulnerable children.

The executive order aims to streamline the institutional response, bypass systemic administrative delays, and eradicate police apathy during critical initial search windows.

 Chairs a high-level meeting of the District Anti Human Trafficking Unit (AHTU), Deputy Commissioner Anupam Kashyap emphasized that any report regarding a missing individual must result in the instantaneous registration of a First Information Report (FIR).

Under the rigid framework reinforced by the apex court in the G. Ganesha vs State of Tamil Nadu case, local police stations can no longer delay legal registration under the pretext of conducting preliminary inquiries. Kashyap made it clear that standard bureaucratic formalities must be cast aside to prioritize active fieldwork.  

The new administrative directives mandate that whenever a child goes missing, law enforcement must legally proceed under the immediate statutory presumption of kidnapping or abduction. Relevant serious penal provisions under the Bharatiya Nyaya Sanhita (BNS), 2023, will be applied right from the onset to mobilize state resources effectively.

Furthermore, the administration plans to fully equip and upgrade specialized anti-trafficking units with advanced tracking technology to counter inter-state trafficking syndicates.  To build a robust safety net, the Deputy Commissioner also announced a comprehensive district-level child protection workshop scheduled within the next three weeks.

This collaborative forum will bring together welfare institutions, judiciary experts, and non-governmental organizations to sync efforts, accelerate target recovery goals, and restore intercepted individuals to their legitimate guardians safely within 24 hours of rescue.
