Big Setback for Sukhu Govt: Supreme Court Dismisses SLP on Employee Seniority and Financial Benefits

Shimla :  In a major blow to the Chief Minister Sukhvinder Singh Sukhu-led Himachal Pradesh government, the Supreme Court has dismissed the state’s Special Leave Petition (SLP) challenging a High Court verdict that struck down legislation affecting government employees' seniority and service benefits.

A Supreme Court bench comprising Justice Vikram Nath and Justice Sandeep Mehta dismissed the state's plea in the matter of State of Himachal Pradesh vs. Devendra Kumar & Others. With this decision, the apex court upheld the earlier ruling of the Himachal Pradesh High Court, which had invalidated the state’s 2024 recruitment and service conditions law.

Origin of the Legal Dispute
The controversy stems from shifting policy decisions regarding contract employees in the state over the years. Initially, commission-passed employees were regularized after eight years of contractual service. This duration was progressively reduced to six, five, and eventually three years.

To address disparities created by these varying contract durations, several employees approached the judiciary. The High Court previously ruled in favor of the employees, ordering that seniority and financial benefits be calculated from their original date of appointment rather than their regularization date.

Legislative Pushback and Judicial Intervention
In response to judicial rulings favoring the employees, the Sukhu-led Congress government passed the Himachal Pradesh Government Employees Recruitment and Conditions of Service Bill, 2024 during the December 2024 winter assembly session. The legislation sought to circumvent court orders granting retroactive seniority and monetary perks.

However, the state's workforce challenged the new law in the High Court. On April 25, 2026, a High Court division bench comprising Justice Vivek Singh Thakur and Justice Romesh Verma struck down the 2024 Act, declaring it unconstitutional and restoring employee rights.
